Welcome to CondoCalls. These Terms of Service explain how you may access and use our website, communication tools, and call-routing platform. By using CondoCalls, you agree to these Terms and our Privacy Policy.

1. Access Through Your Building Partner

Your condominium corporation, developer, or property manager (“Building Partner”) has an agreement with CondoCalls that enables your access. You do not enter into a commercial contract with CondoCalls. You receive access because your Building Partner selected CondoCalls for building operations such as security calls, visitor verification, and communication workflows. Your Building Partner may not offer alternatives to CondoCalls for these operations. CondoCalls is not responsible for providing alternative communication or access methods.

By using the Platform, you confirm that:

• Your access comes from your Building Partner’s arrangement with us

• Your use must follow these Terms

• You understand that opting out may not be possible due to building requirements

  
  

2. Eligibility and Accounts

You may only use the Platform if your Building Partner has an active agreement with us.

You are responsible for:

• Keeping your contact information accurate

• Protecting your login credentials

• All activity under your account

If you believe your account was compromised, update your password or contact support@condocalls.ca.

We may suspend or terminate your access if:

• You violate these Terms

• Your Building Partner’s agreement ends

• We believe your account poses a security risk

  
  

3. Changes to These Terms

We may update these Terms at any time. Updated Terms will be posted on condocalls.ca. Continued use means you accept the changes.

4. Privacy

Our Privacy Policy explains how we collect, use, and protect personal information. By using the Platform, you agree your information may be handled as described there.

5. License and Acceptable Use

We grant you a limited, revocable, non-exclusive right to access the Platform in your web browser.

You may not:

• Reverse engineer, copy, or resell any part of the Platform

• Use bots, scrapers, or automated tools

• Attempt to access restricted areas or data

• Interfere with Platform security

• Use the Platform for unlawful, harmful, or abusive purposes

  
  

6. User Content

You may submit information such as call preferences, visitor details, messages, and settings (“User Content”).

You agree that:

• You have the right to provide the User Content

• User Content does not violate anyone’s rights

• You will not upload anything abusive, unlawful, or inappropriate

By submitting User Content, you grant CondoCalls a worldwide, royalty-free license to use it as needed to operate the Platform. You waive any moral rights in the User Content.

7. Communication and Call Routing Features

The Platform includes:

• Intercom forwarding

• Security call routing

• Visitor access workflows

• Resident communication tools

• Activity logs

You understand that:

• Call delivery depends on telecom networks

• CondoCalls cannot guarantee uninterrupted service

• Accurate contact info is required for correct call routing

  
  

8. Feedback

If you send us ideas or suggestions, you agree we may use them freely without compensation.

9. Prohibited Conduct

You may not:

• Impersonate another person

• Harass building staff or residents

• Upload malware

• Attempt unauthorized access

• Send spam or bulk messages

• Violate laws while using the Platform

  
  

10. Third-Party Services

The Platform integrates with telecom networks, email providers, and other systems. CondoCalls is not responsible for the content or performance of third-party services.

11. Intellectual Property

All software, design, text, graphics, and branding belong to CondoCalls or our licensors. You may not copy or reuse Platform content without permission.

12. Disclaimer of Warranties

The Platform is provided “as is” and “as available.”

We do not guarantee:

• Error-free or uninterrupted service

• Accurate or complete information

• That communication features will work in all conditions

• That the Platform will work on every device or browser

You use the Platform at your own risk.

13. Limitation of Liability

To the fullest extent permitted by law, CondoCalls is not liable for:

• Indirect or consequential damages

• Loss of data, profits, or opportunities

• Call failures or communication delays

• Unauthorized access to your account

• Issues caused by third-party networks

Our total liability to you will not exceed the amount your Building Partner paid for your access.

14. Indemnification

You agree to defend and indemnify CondoCalls against claims arising from:

• Your use or misuse of the Platform

• Your violation of these Terms

• Your infringement of third-party rights

  
  

15. Security

Attempting to hack, bypass, or compromise the Platform is prohibited. We may cooperate with law enforcement if needed.

16. Dispute Resolution

Any dispute related to these Terms will be resolved through binding arbitration in Toronto, Ontario, under the rules of the ADR Institute of Canada.

17. Governing Law

These Terms are governed by the laws of Ontario and Canada’s federal laws. For matters not handled through arbitration, you agree to Ontario court jurisdiction.

18. Termination

Your access ends if:

• Your Building Partner’s agreement ends

• You violate these Terms

• We suspend or terminate access for security or compliance reasons

You may stop using the Platform at any time.

19. Entire Agreement

These Terms and the Privacy Policy form the complete agreement between you and CondoCalls regarding your use of the Platform.

20. Assignment

You may not transfer your rights under these Terms. CondoCalls may assign these Terms.

21. Severability

If any part is invalid, the rest remains in effect.

22. No Waiver

If we do not enforce a right, it does not waive that right.

23. Language

These Terms are provided in English.
